Interview questions

During an interview, certain questions will be asked of you by your potential employer.  In the state of Texas, there are certain personal questions that should not be asked and you do not have to answer them.  If an employer has violated your privacy by asking personal questions during an interview, you have the right to take legal action.  McAllen’s trusted employment lawyer at The Pruneda Law Firm can help you defend your case.

What you should know

There is a policy when it comes to interview questions.  Employers should not ask certain questions and cannot base their hiring decision on responses to those questions.  Interview questions that should not be asked include:

  • Are you married?
  • Are you planning to get married?
  • Where were you born?
  • What is your sexual orientation?

There are some questions employers will ask in order to determine your ability to fulfill the job’s requirements.  Employers have the right to ask the following questions:

  • Have you ever been convicted of a crime?
  • Can you prove your eligibility to work in the United States?
  • Can you do this job with or without reasonable accommodations?
